Terms of Use & End‑User Licence Agreement (EULA)
Welcome to MappX! These Terms of Use and End‑User Licence Agreement ("Terms") govern your access to and use of the MappX mobile application, website and related services (together, the "Service"). The Service is provided by Leandro Di Bella (trading as “MappX”), Belgium (referred to as “we”, “us”, “our”).
By creating an account, downloading the app or otherwise using the Service you confirm that you have read, understood and agree to be bound by these Terms and by our Privacy Policy.
1. Who Can Use MappX
- You must be at least 16 years old, or the lower digital age of consent set by your country (never below 13). If you are under that age you may only use the Service with verifiable parental or guardian consent.
- You must not be subject to EU or local sanctions or otherwise barred from using the Service under applicable law.
- If you accept these Terms on behalf of an organisation you represent that you have authority to bind that organisation.
2. Account Registration & Security
- You are responsible for all activity that occurs under your account. Keep your password confidential and secure your device.
- You must provide accurate information. Impersonating others or providing false details is prohibited.
- We may suspend or terminate accounts that violate these Terms, our Community Guidelines or the law.
- You may delete your account at any time in the app settings or by emailing info@mappx.app.
3. Your Content & Permissions
- You retain all intellectual‑property rights in photos, text and other content you upload ("User Content").
- To operate the Service, you grant us a non‑exclusive, transferable, sub‑licensable, royalty‑free, worldwide licence to host, use, distribute, modify, publish, publicly display and create derivative works from your User Content solely to provide, promote and improve the Service. This licence ends when you delete the content or your account, except where the content has been shared by others.
- We may place your username or avatar next to paid or sponsored content shown to other users. We do not share personal data with advertisers without consent and never target ads to users known to be minors.
4. User-Generated Content Policy & Prohibited Behaviour
As a platform that allows users to share content, we strictly prohibit:
- Objectionable Content: Do not post content that is illegal, hateful, harassing, discriminatory, pornographic, sexually explicit, violent, exploitative, defamatory, fraudulent, deceptive or otherwise harmful.
- Harmful Behavior: Bullying, stalking, intimidation, hate speech, threats, and harassment of any kind are strictly prohibited.
- Misinformation: Deliberately false or misleading content that could cause harm is not allowed.
- Child Safety: Any content that exploits, endangers, or sexualizes minors is strictly prohibited and will be reported to authorities.
- Illegal Activities: Content that promotes or facilitates illegal activities, including copyright infringement, is prohibited.
- Technical Abuse: Do not scrape, crawl, reverse‑engineer or attempt to access areas of the Service you are not authorised to access.
- Security Threats: Do not upload malware or engage in activity that could disrupt or harm the Service or other users.
Users who violate these policies may have their content removed immediately, their accounts suspended or permanently banned, and in serious cases, may be reported to law enforcement.
5. Content Moderation, Reporting & Appeals
To ensure compliance with App Store Guideline 1.2 and to maintain a safe environment, we implement:
- Pre-Publication Review: High-risk content may be subject to manual review before being published.
- Automated Filtering: We use AI-based detection systems to identify potentially objectionable content.
- User Reporting: All users can report objectionable content via the "Report" button on any post. We review all reports within 24 hours.
- Moderation Team: Our dedicated moderation team reviews flagged content and takes appropriate action based on our policies.
- Account Restrictions: We may remove content or suspend accounts that violate these Terms, our policies or the law, or to protect users.
- Appeals Process: If your content or account was removed or limited in error you may appeal within 14 days via the in‑app appeal button or by emailing info@mappx.app. We review appeals within a further 14 days.
- Legal Compliance: We cooperate with law enforcement and comply with legal requirements for reporting illegal content.
- You may also use an EU‑recognised out‑of‑court dispute‑resolution body for unresolved issues.
Parents and guardians can contact us at safety@mappx.app with specific concerns about content that may affect minors.
6. Software Licence
- We grant you a limited, revocable, non‑exclusive, non‑transferable licence to download and run the MappX app on your personal device for private, non‑commercial purposes, subject to these Terms.
- You may not copy, modify, distribute, sell, lease or reverse‑engineer the software except where such restrictions are prohibited by law.
7. Third‑Party Services & Links
- The Service may contain links to third‑party sites or use third‑party services (e.g. map tiles, cloud storage). We are not responsible for third‑party content, terms or privacy practices.
8. Right of Withdrawal (EU Consumers)
You may withdraw from these Terms within 14 days after first installing or registering for MappX without giving any reason. To exercise this right email info@mappx.app and delete your account. If you start posting content before the 14‑day period ends you request early performance and acknowledge that the right of withdrawal is lost once full performance has occurred.
9. Changes to the Terms
- We may amend these Terms to reflect legal requirements or improvements to the Service. We will notify you at least 15 days before material changes take effect.
- If you object, you may terminate your account before the effective date. Continued use after that date constitutes acceptance of the new Terms.
10. Disclaimers
The Service is provided "as is" and "as available" without warranties of any kind, express or implied. We do not warrant that the Service will be uninterrupted, secure or error‑free.
11. Limitation of Liability
To the extent permitted by law, we shall not be liable for indirect, consequential, special or incidental damages or loss of data, profits, goodwill or reputation. Nothing in these Terms limits or excludes liability for death, personal injury, gross negligence, wilful misconduct or any liability that cannot be excluded by law.
12. Indemnity
You agree to indemnify and hold harmless Leandro Di Bella from any claim, demand, loss or damage arising out of your breach of these Terms or violation of any law or third‑party rights.
13. Disputes, Governing Law & Jurisdiction
These Terms are governed by Belgian law and applicable EU law. The courts of Walloon Brabant, Belgium, have exclusive jurisdiction, except that you may bring claims under mandatory consumer‑protection rules in your EU country of residence. You may also use the EU ODR platform (ec.europa.eu/consumers/odr).
